Limited Warranty
Products are warranted against defects in materials or workmanship only in accordance with the individual manufacturer's warranty policy. If Gemini Safety Labels determines the product to be defective in workmanship or material, it will be repaired or replaced at Gemini Safety Labels' sole option, as the buyer's exclusive remedy.
Return Policy
If, for any reason, you are not 100% satisfied with a stock product you receive from Gemini Safety Labels, you may return the product within 30 days from the time of receipt, for a full refund or exchange of the product you purchased. Within this time, products may be returned, freight prepaid, and must be in their original packaging and in resalable condition. A Return Authorization Number must be obtained from Gemini Safety's Customer Service Department, and the client must provide the Invoice number at the time of the request. Gemini Safety Labels has the right to refuse any shipments without this authorization. Gemini Safety Labels inspects all returns and reserves the right to refuse credits on damaged, used, or non-resalable items. Returns may be subject to restocking fees based on the return policy of the manufacturer, as well as shipping or other fees, and must be received within 10 days of receiving the Return Authorization Number.

Delivery
Freight rates quoted are to be considered dock-to-dock. If extra handling is required, additional charges may apply. Gemini Safety Labels can also offer consolidated shipping for large-volume customers.
Shipping errors, missing items, or damages must be reported to Gemini Safety Labels within 1 business day of receipt of shipment (damages must be accompanied by a signed bill of lading acknowledging the damage).
FOB Points. The products displayed on this website ship FOB stocking warehouse or FOB the manufacturer, as indicated within product details. Not all products are stocked and shipped from all of our locations. Upon submission of your quote or order, the shipping origin and any applicable freight charges will be confirmed.

Special Orders & Product Availability
Products are subject to availability at time of order. Some special order items must meet manufacturer's minimum order quantity requirements at the time of order and may require additional shipping time.

Sales Tax
Gemini Safety Labels is required to charge Sales Tax on items for which a sales tax exemption certification has not been provided. When ordering, please provide any valid exemption certificate.
Pricing
Prices are listed in USD and will remain valid for a period of 30 days of the Quotation. In the event of a pricing error, Gemini Safety Labels reserves the right to change the price without notice. We also reserve the right to change prices based on changing economic and manufacturing conditions. For accurate pricing, please verify your required products with sales. Quotations on large quantities are available on request.
Right to Limit Orders
Supplier reserves the right to limit or refuse any order. Supplier may, in its sole discretion, limit or cancel quantities purchased per person, business, or order. These restrictions include orders placed by or under the same customer account, the same credit card, and orders that use the same billing or shipping address. In the event the Supplier makes a change to or cancels an order, Supplier will attempt to notify the Purchaser by contacting the email, billing address, or phone number provided at the time of order. Supplier reserves the right to limit or prohibit orders that, in Supplier’s sole judgment, appear to be placed by unauthorized resellers or distributors.
Site Errors
Information on Supplier’s Sites may inadvertently contain typographical errors, inaccurate information, or omissions (collectively, “Errors”) related to product descriptions, pricing, promotions, offers, and availability. If any Sites contains Errors, without prior notice (including after the Purchaser submits an order), Supplier reserves rights to: (1) correct Errors; (2) change or update applicable Site information; and (3) cancel orders made in reliance on Errors.
LIMITATION OF LIABILITY
Gemini Safety Labels will not be liable for any indirect, special, incidental, consequential, or exemplary damages, whether based on contract, tort, or any other legal theory, including without limitation loss of revenue or profits, loss of business, or other economic damages, even if such damages were foreseeable or if Gemini Safety Labels has been notified of the possibility of such damages. Where the Customer is purchasing products from Gemini Safety Labels for personal, family, or household use, some states do not allow the exclusion of incidental or consequential damages, so the above exclusions may not apply in those cases. Gemini Safety Labels is not responsible for delivery delays that result from any circumstances beyond Gemini Safety Labels' control and will not be liable for damages resulting from such delays. Gemini Safety Labels’ aggregate liability for any claim arising out of or related to these Terms shall not exceed the purchase price paid by the Customer for the products to which such claim relates.
WEBSITE SPECIFIC TERMS
Websites provided by the Supplier are for the service of our customers. Use of the Sites indicates acceptance of the following website-specific terms (“Site Terms"). If Purchaser does not agree to the Site Terms, Purchaser should not use the Sites.
FORCE MAJEURE
Gemimi Safety Labels shall not be liable or responsible to Customer for any failure or delay in fulfilling or performing any of these Terms when and to the extent such failure or delay is caused by or results from acts beyond Gemini Safety Labels’s reasonable control, including, without limitation, (1) acts of god; (2) flood, fire, earthquake, pandemic, epidemic, or explosion; (3) war, invasion, terrorist threats or acts, riot or other civil unrest; (4) government order, law, or actions; (5) embargoes or blockades in effect on or after the date of this agreement; (6) national or regional emergency; (7) strikes, labor stoppages or slowdowns, or other industrial disturbances; (8) other events beyond its reasonable control.
Waiver
Supplier will not be deemed to have waived any provision of these Terms and Conditions or any breach by Purchaser, unless specifically set forth in writing and executed by an authorized representative of Supplier. No such waiver by Supplier will constitute a waiver of such provision or breach on any other occasion.
NO CONSEQUENTIAL DAMAGES
Except as expressly provided herein, neither Supplier nor Purchaser shall be liable to the other for any indirect, special, punitive, or consequential damages; whether foreseeable or unforeseeable; whether based upon lost goodwill, lost resale profits, loss of use of money, work stoppage, impairment of other assets, or otherwise; and whether arising out of breach of warranty, breach of contract, strict liability in tort, negligence, misrepresentation, or otherwise; except in the case of personal injury (including death) where applicable law requires such liability.
Regulatory Products
Customers are solely responsible for determining the suitability and regulatory compliance of products for their intended use. Gemini Safety Labels does not provide legal, regulatory, or compliance certification unless expressly stated in writing.
INDEMNIFICATION
To the extent allowed by law, Customer agrees to protect, defend, indemnify and hold harmless Gemini Safety Labels, its officers, employees, agents, and representatives and each of their successors and assigns against any claims, allegations, demands and proceedings, and any liabilities, losses, judgments, penalties, settlements and costs, including without limitation attorneys’ fees and expenses, arising from or related to any actual or alleged negligence or intentional misconduct of Customer as related to Customer’s purchase, sale or use of Gemini Safety Labels products.
